The 10-year rule for undocumented immigrants is a U.S. immigration rule that can stop a person from returning to the United States for 10 years if they lived in the country without legal status for one year or more and then leave. This rule is often called the 10-year unlawful presence bar.

How the 10-Year Rule Works

A person builds unlawful presence when they stay in the United States without permission or after their visa expires.

Here is how the rule works:

  • If someone stays in the U.S. more than 180 days but less than one year without status and then leaves, they may face a 3-year ban.
  • If someone stays one year or more without status and then leaves, they may face a 10-year ban.

The ban starts when the person leaves the United States, not while they are still here.
